Terms of Service

These Terms of Service ("Terms") govern your use of the FixTax.ca website and related inquiries. "FixTax.ca", "we", "us", and "our" mean the business operating this website. By using the website or submitting information, you agree to these Terms. If you do not agree, do not use the website.

Website use

This website provides general information only. It is not a substitute for professional advice and may not reflect your facts, tax year, or current law. We may change, suspend, or discontinue any website content or feature without notice.

No engagement until confirmed

A form submission, phone call, email, upload, payment, or automated message is an inquiry and does not create an accountant-client relationship or require us to accept your matter. A professional relationship begins only when we expressly accept the engagement and any required engagement letter or service agreement is completed.

Service requests and communications

We may confirm availability, scope, required documents, fees, deadlines, and engagement terms before starting work. You authorize us to communicate with you using the contact information you provide. Electronic communications may not be secure or error-free, and you should promptly tell us if your contact details change.

Estimates and no guarantee

Any refund estimate, price, deadline, processing time, tax result, penalty reduction, audit result, or other content is general information only and is not a promise or guarantee. Actual results depend on complete and accurate facts, documents, tax year, CRA decisions, processing times, applicable law, and information outside our control. We do not guarantee a refund, filing acceptance, assessment, reassessment outcome, deadline extension, or absence of interest or penalties.

Your responsibilities

You must provide complete, accurate, and timely information; identify all relevant income, assets, deductions, and prior filings; review documents and calculations; answer questions; meet payment and approval deadlines; and promptly correct errors you discover. We may rely on information you provide and are not responsible for consequences caused by incomplete, inaccurate, misleading, late, or unauthorized information.

Fees, payment, and cancellation

Fees, deposits, taxes, payment timing, cancellation terms, and refunds will be stated in the applicable engagement or invoice. Work may be paused or declined for non-payment, missing information, conflicts, legal or professional restrictions, or other reasonable grounds. Unless required by law or agreed in writing, fees for work already performed and approved third-party costs are non-refundable.

Documents and electronic records

You authorize us to use documents and information you provide for the requested services. You should retain your own originals and backups. We may refuse files that are unsafe, corrupted, unsupported, unlawful, or submitted through an unsuitable channel.

Website and transmission risks

To the fullest extent permitted by law, we are not responsible for the operation, availability, security, reliability, or performance of the website or related systems, or for the loss, corruption, interception, delay, failed transmission, or non-receipt of any data, message, payment, or file. We do not guarantee that documents uploaded or sent through the website will reach us on time or at all. You are responsible for keeping copies of your documents and confirming that important submissions have been received.

Prohibited use

You must not use the website unlawfully, submit information belonging to another person without authority, upload malicious code, attempt unauthorized access, interfere with the website, reverse engineer, decompile, disassemble, or otherwise analyze the website or its code to identify vulnerabilities or attempt to compromise, bypass, or disrupt its security, or use our content, branding, or systems for commercial purposes without written permission.

Intellectual property

The website, content, branding, layout, graphics, and software are owned by or licensed to FixTax.ca and are protected by applicable law. We grant you a limited, revocable, non-transferable right to use the website for its intended personal and business inquiry purposes.

Third-party services

This website may link to or rely on third-party services such as WhatsApp, hosting, payment, email, mapping, or tax-related services. Their terms and privacy policies apply to your use of those services. We are not responsible for third-party availability, content, acts, omissions, or security.

Disclaimer of warranties

To the fullest extent permitted by law, the website and its content are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, accurate, complete, current, secure, or free of errors or harmful components.

Limitation of liability

To the fullest extent permitted by law, FixTax.ca and its owners, employees, contractors, and advisers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost income, lost data, lost savings, business interruption, penalties, interest, or tax outcomes arising from or related to the website, an inquiry, delayed communication, third-party service, or services provided. Our total aggregate liability for a claim will not exceed the fees you paid to us for the specific service giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Indemnity

To the fullest extent permitted by law, you agree to indemnify and hold harmless FixTax.ca and its owners, employees, contractors, and advisers from claims, losses, liabilities, costs, and expenses arising from your breach of these Terms, misuse of the website, unauthorized submission of information, or inaccurate, incomplete, or unlawful information you provide.

Governing law and dispute process

These Terms are governed by the laws of Ontario and the applicable laws of Canada, without regard to conflict-of-law rules. Subject to mandatory law, disputes will be brought before the courts located in Ontario, Canada. Before starting formal proceedings, you agree to contact us in writing and give us a reasonable opportunity to investigate and resolve the concern.

Changes and general terms

We may update these Terms by posting a revised version with a new effective date. If any provision is unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will continue. These Terms and any applicable engagement agreement or invoice are the entire agreement for website use. An engagement agreement controls if it conflicts with these Terms.
